Top OSHA Violations

The Occupational Safety and Health Administration announced the preliminary top 10 most-frequent workplace safety violations for 2009. The frequency of these violations increased almost 30% over the same time period in 2008.
Workplace Violations:
1. Scaffolding - 9,093 violations
2. Fall Protection - 6,771 violations
3. Hazard Communication - 6,378 violations
4. Respiratory Protection - 3,803 violations
5. Lockout-Tag out - 3,321 violations
6. Electrical (Wiring) - 3,079 violations
7. Ladders - 3,072 violations
8. Powered Industrial Trucks - 2,993 violations
9. Electrical - 2,556 violations
10. Machine Guarding - 2,364 violations

DOT Safety Council Meets

On October 26, the U.S. Department of Transportation convened the first meeting of a newly created DOT Safety Council, which was formed to tackle critical transportation safety issues facing the department’s 10 operating administrations.

Before taking office, DOT Secretary Ray LaHood saw that many important safety initiatives were being pursued in the department’s agencies without a formal process for sharing data, best practices and strategies. LaHood created the Safety Council to serve that broad-based safety leadership role and help break down organizational stovepipes, enabling an even stronger safety culture.

The Safety Council's goals are to further enhance the safety focus throughout all agencies of the department and improve the impact of the department’s safety programs.

The Council, chaired by Transportation Deputy Secretary John Porcari, is comprised of the heads of the Department’s 10 agencies: the Federal Aviation Administration, the Federal Highway Administration, the Federal Motor Carrier Safety Administration, the Federal Railroad Administration, the Federal Transit Administration, the Maritime Administration, the National Highway Traffic Safety Administration, the Pipeline and Hazardous Materials Safety Administration, the Research and Innovative Technology Administration and the St. Lawrence Seaway Development Corporation.

PHMSA Issues Final Rule on Hazmat Emergency Response The Pipeline and Hazardous Materials Safety Administration (PHMSA) has published a final rule on emergency response safety information, HM-206F. 74 Federal Register 53413 (October 19, 2009). PHMSA amended the Hazardous Materials Regulations to clarify requirements governing emergency response information services provided by arrangement with third party providers on behalf of hazardous materials offerors (shippers). In the final rule, PHMSA is requiring basic identifying information (offeror name or contract number) to be included on shipping papers.

According to the agency, this information will enable the emergency response information provider to identify the offeror on whose behalf it is accepting responsibility for providing emergency response information in the event of a hazardous materials incident and obtain additional information about the hazardous material as needed.

In addition, the final rule states that for hazmat shipments handled by several carriers or intermediaries, any person preparing a subsequent shipping paper for continued transport of a hazardous materials shipment must include the offeror’s name (whether the original or subsequent offeror) that is the registrant for the emergency response information (ERI) provider and that will be in use for the continued transportation of the shipment. The name of the original or subsequent offeror or its contract number with the ERI provider must be included on the shipping paper. If the original or subsequent offeror is not continuing as the registrant with the ERI provider, the person preparing subsequent shipping papers must insert and identify by name its own valid emergency response telephone number conforming to the requirements in Subpart G of Part 172.

The agency has clarified that the effective date of the final rule is October 1, 2010. Voluntary compliance is allowed beginning November 18, 2009.

FMCSA Announces Driver Pre-Employment Screening Program The Federal Motor Carrier Safety Administration (FMCSA) announced that it will launch a new Driver Pre-Employment Screening Program, which will allow commercial motor carrier companies to electronically access driver inspection and crash records as a part of the hiring process. The program is expected to begin in December 2009.

The agency said that by using driver safety information during pre-employment screening, motor carriers will be able to better assess potential safety risks of a prospective driver-employee, and drivers will have additional opportunities to verify the data in their driving history and correct any discrepancies. Commercial driver safety records are currently available to federal and state law enforcement personnel, and accessible to drivers through the Freedom of Information Act (FOIA). Once the pre-employment screening program is launched, driver safety records will be readily available to motor carriers regardless of state or jurisdiction. In accordance with federal privacy laws, drivers must first give written consent in order for their records to be released.

The Driver Pre-Employment Screening Program will be populated by FMCSA's Motor Carrier Management Information System (MCMIS). The MCMIS is comprised of driver performance data including roadside inspection and compliance review results, enforcement data, state-reported crashes and motor carrier census data.

 


DOT States Medical Marijuana Not Allowed for Transportation Workers
The Department of Justice (DOJ) has issued guidelines for federal prosecutors in states that have enacted laws authorizing the use of "medical marijuana," advising those prosecutors not to charge persons obtaining or using marijuana for personal medical use. In light of those guidelines, the Department of Transportation has reiterated that the DOJ guidelines will have no bearing on DOT’s regulated drug testing program, including the drug testing requirements for commercial motor vehicle drivers. DOT will not change its regulated drug testing program based upon these guidelines to federal prosecutors.

Specifically, DOT's drug and alcohol testing regulation—49 CFR Part 40, at 40.151(e)—does not authorize "medical marijuana" under a state law to be a valid medical explanation for a transportation employee's positive drug test result. Therefore, Medical Review Officers will not verify a drug test as negative based upon information that a physician recommended that the employee use "medical marijuana." Marijuana remains a drug listed in Schedule I of the Controlled Substances Act, and it remains unacceptable for any safety-sensitive employee subject to drug testing under the Department of Transportation’s drug testing regulations to use marijuana.

Branching Out (Milwaukee, WI)Weld Specialty Supply expanded its Milwaukee facility, adding 7,500 sq. ft. to its warehouse, 400 sq. ft. to its showroom and 4 new loading docks. The company also built a new 10,000-sq.-ft. facility in Fon Du Lac, WI, which is roughly halfway between the company’s locations in Milwaukee and Kaukauna, WI. Weld Specialty Supply now has 3 locations in Wisconsin.

House Upkeep (Corpus Christi, TX)Weldinghouse hired new purchasing agent Michelle Charles on October 27. Charles is new to the gases and welding industry but has extensive experience in purchasing activities. Previously, Charles worked in the aircraft, pharmaceutical and food industries. Mayer has 4 years' experience in industrial purchasing and inventory control. She is responsible for internal process improvement and special projects.

Matheson Tri-Gas Adds Divisions and Reorganizes Management (Basking Ridge, NJ)Matheson Tri-Gas reorganized the company's field operations in an effort to standardize best business practices from across the MTG team. Five Customer-Facing Divisions report to COO Scott Kallman, who is now also president. Those 5 divisions are: International & Helium; Electronics & Solar; Bulk; Packaged; and Specialty Gas, Equipment and Chemical. The organization will utilize Supply Chain Management to optimize operations.

Hydrogen Horizon (Luling, LA) • Air Products signed a long-term supply contract with Monsanto Company to build a new world-scale hydrogen production plant in Luling, LA. The plant is scheduled to be on-stream in January 2012.

Brand Change (Murray Hill, NJ)Linde North America’s 2006 acquisition Spectra Gases, is changing its name to Linde. The brand change is intended to fully integrate Spectra Gases into Linde’s global research and development, production and distribution network.

Dan Steele
, 70, was one of the first employees hired by Larry Kissler immediately after Mr. Kissler purchased Norco Inc. in 1968. Mr. Steele worked for Norco for more than 33 years, serving as president from 1991 until 1999 and on the board of directors until 2005. Mr. Steele recruited, trained and mentored many members of the company’s current management staff. Norco President James Kissler notes that Mr. Steele established a high standard for employees through his work ethic, his integrity and his steadfastness. “You could always rely on him,” says Kissler.
