Welding Fume Litigation Update
Industry Wins California Trial The welding industry won the first test trial in the California coordinated welding products liability litigation. On February 11, an Alameda County jury returned a verdict in favor of defendants Lincoln Electric Co., ESAB Group and Hobart Brothers Company. After deliberating less than 4 hours, the jury concluded that plaintiff Elbert Thomas suffers from Parkinson’s disease, not from any injury relating to welding fume exposure. The jury also found that defective warning labels could not have caused Thomas to suffer any injury, as he did not read any of the labels. The trial began on January 12.
GAWDA's Coordinating Counsel for Welding Fume Litigation Mike Degan hailed the victory as further evidence that there is no merit to welding fume lawsuits. "In case after case, juries have rejected claims that exposure to welding fumes has caused injury. Plaintiffs are simply unable to find traction in even the most plaintiff-friendly jurisdictions, such as Mississippi, Louisiana, Illinois, Texas and now California," Degan says.
The welding industry has won 22 of the 26 welding fume cases that have gone before juries. Several thousand additional cases have been voluntarily dismissed. Degan notes the increasing number of voluntary dismissals as further evidence that plaintiffs and their lawyers are losing interest in pursuing these claims.
Dickie Scruggs Sentenced For Bribery (Again) Famed "King of Torts" lawyer and architect of welding fume litigation Richard "Dickie" Scruggs pled guilty February 10 to bribery charges in a second case in which Scruggs attempted to corrupt the judicial system. Scruggs, who already is serving 5 years in jail for attempting to bribe another Mississippi judge, was sentenced to a concurrent 7-year jail term. Scruggs admitted that he attempted to entice a second Mississippi judge to rule in his favor in a dispute over attorney fees in an asbestos case by promising to influence an appointment to the federal bench. Scruggs and attorney Don Barrett were among the principal movers behind the explosion of welding fume lawsuits beginning in 2004.

Central Welding Opens 12th Store (Marysville, WA) Central Welding Supply has begun construction on its 12th branch. "We have acquired a highly-visible 2-acre site off Highway 20 in Anacortes, WA, to better service customers in the area," says President and CEO Dale Wilton. The 3,200 sq. ft. steel building is expected to open in late summer.

Cylinder Recyclers Earns Award (Rockport, MA) Ohio's Hamilton County Solid Waste Management District recognized Cylinder Recyclers for decreasing the amount of solid waste going to regional landfills and reintroducing useable commodities back into the manufacturing process. During 2008 alone, the company reclaimed and recycled over 75 tons of acetone with its acetylene tank recycling program.
Lear Joins Jackson Welding (Pittsburgh, PA) Jackson Welding Supply hired Cathy Lear as a customer service representative. Lear previously worked for a crime scene analysis company, where she was in charge of ordering gases and related supplies.

Kaplan Opens New Warehouse (Maple Shade, NJ) Kaplan Industries opened its second warehouse in Maple Shade, NJ. The 25,000 sq. ft. building will provide for a larger inventory, reducing turnaround times. The additional space also allows for a new paint line with 350 stations, a 250-ton press to emboss collars in-house and Galiso test equipment for cylinder maintenance.

Pacific Welding Changes Management (Tacoma, WA) Mike Fox Sr. has completed negotiations with his founding partner Paul Van Dyke to take sole ownership of Pacific Welding Supplies. Fox is now CEO of the company, and Van Dyke has retired. The following management moves have also been made: Pete Hochstatter, president; Bob Hankel, vice president of sales; and Mike Fox Jr., vice president of operations.
